By accepting this quote, you agree to Cascone Roofing's Terms and Conditions of Trade, available at casconeroofing.com . Acceptance may occur by a signature, written or emailed approval, or issue of a purchase order referencing this quote.
Part 1 - General Terms of Trade
1. Scope of Work
1.1 These Terms govern all roof plumbing, re-roofing, repairs, leak detection, cladding and associated metal roofing works performed by Cascone Roofing.
1.2 Our obligations are limited to the quoted scope and any agreed written variations.
2. Regulatory Compliance
2.1 Cascone Roofing operates under plumbing licences issued by the Victorian Building Authority / Building and Plumbing Commission (BPC).
2.2 Where required by the Plumbing Regulations 2018 (Vic), a Compliance Certificate will be lodged within five (5) business days of completion.
2.3 Certificates cannot be withheld for non-payment; payment obligations remain enforceable separately.
2.4 All materials and installation comply with the Plumbing Code of Australia, relevant AS/NZS standards and WaterMark certification where applicable.
3. Quotations and Acceptance
3.1 Quotes are valid for 30 days unless stated otherwise.
3.2 Acceptance occurs when you sign, email confirmation, issue a purchase order, or otherwise authorise us to proceed.
3.3 Quoted prices may be adjusted by written agreement to reflect supplier price changes or unforeseen conditions.
4. Deposits and Payment
4.1 Unless otherwise stated, a 30% deposit is payable before commencement, with the balance due 7 days after completion.
4.2 For larger commercial projects, progress claims may be issued under Part 2.
4.3 Interest accrues on overdue amounts at 2% per month (24% p.a.) until paid.
4.4 All reasonable costs of debt recovery (including legal and collection fees) are recoverable as a debt.
4.5 Payments are to be made without deduction or set-off.
5. Title and Risk
5.1 Ownership of all materials remains with Cascone Roofing until full payment is received.
5.2 Risk passes to the client upon installation or delivery to site, whichever occurs first.
6. Variations and Latent Conditions
6.1 Any variation must be approved in writing (email is sufficient) by the contracting party.
6.2 Where hidden conditions arise, including rotten timbers, asbestos, unsafe substrates, or prior non-compliance, work will pause pending a written variation.
6.3 Additional costs and delays arising from such conditions are payable as variations.
7. Site Access and Safety
7.1 Unless otherwise agreed, Cascone Roofing provides scaffolding and edge-protection suitable for the works.
7.2 You must ensure safe, clear access to the work area and compliance with OHS/WHS requirements.
7.3 Cascone Roofing does not handle asbestos or lead removal; such work must be arranged by others before our attendance.
8. Materials and Substitution
8.1 Materials will meet relevant standards and performance requirements.
8.2 Equivalent substitutions may be made where original items are unavailable, provided compliance and quality are maintained.
9. Defects and Warranties
9.1 Cascone Roofing provides a defects liability period of 90 days from completion, in addition to statutory rights.
9.2 All regulated plumbing work covered by a Compliance Certificate carries a 6-year workmanship and insurance warranty.
9.3 This warranty does not cover misuse, failure to maintain gutters or roof drainage, or damage caused by external factors (storms, debris, impact of others).
10. Maintenance Obligations
10.1 You must keep gutters and roof drainage clear of leaves and debris, and arrange inspections at least annually.
10.2 Failure to maintain does not constitute a defect under warranty.
11. Delays and Force Majeure
11.1 Cascone Roofing is not liable for delays caused by weather, supply issues, site inaccessibility, or events beyond its control.
11.2 If delay exceeds 10 days, either party may suspend or terminate unperformed work by written notice.
12. Liability and Indemnity
12.1 To the extent permitted by law, Cascone Roofing's liability is limited to the lesser of (a) the cost of re-supplying the services or (b) the contract price for the affected work.
12.2 Cascone Roofing is not liable for consequential or indirect loss (including loss of profit, delay costs, or tenant claims).
12.3 Nothing in these Terms limits rights under the Australian Consumer Law.
13. Cancellation and Termination
13.1 If you cancel after paying a deposit we retain the right to recoup any costs incurred.
13.2 If you cancel after work commences, Cascone Roofing may recover all work performed and committed costs up to termination.
14. Privacy and Marketing
14.1 Cascone Roofing may store client details in CRM systems for project management, invoicing and warranty purposes.
14.2 Cascone Roofing may take photographs of completed work for marketing purposes unless you advise otherwise in writing.
15. Dispute Resolution
15.1 Parties must first attempt to resolve disputes through direct negotiation.
15.2 For domestic clients, unresolved matters proceed to DBDRV and then VCAT.
15.3 For commercial clients, disputes may proceed under the Security of Payment Act 2002 or to VCAT or courts.
16. Governing Law
16.1 These Terms are governed by the laws of Victoria, Australia.
16.2 Each party submits to the exclusive jurisdiction of Victorian courts and tribunals.
Part 2 - Commercial Addendum
(Applies where the client is a builder, body corporate, commercial entity or government client and progress claims are issued.)
1. Progress Claims and Security of Payment
1.1 Cascone Roofing will identify itself as a subcontractor under the Building and Construction Industry Security of Payment Act 2002 (Vic).
1.2 Reference dates will be monthly unless otherwise agreed in writing.
1.3 The client must issue a payment schedule within 10 business days (or the statutory period) of each claim.
1.4 Failure to provide a payment schedule within time entitles Cascone Roofing to recover the claimed amount as a debt.
1.5 Pay-when-paid provisions are void.
2. Progress Payment Timing
2.1 Unless otherwise stated, progress claims are payable 7 days from invoice date.
2.2 Late payment attracts interest and recovery costs per Part 1 clause 4.
3. Extensions of Time
3.1 Cascone Roofing is entitled to a reasonable extension for delays outside its control, including inclement weather, site inaccessibility, variations, or delays by other trades.
4. Retention and Set-Off
4.1 No retention shall apply unless expressly stated in the quote or contract.
4.2 Set-off is not permitted unless the entitlement is agreed or determined by adjudication or court.
5. Termination for Default
5.1 Either party may issue a written notice if the other materially breaches these Terms and fails to remedy within 10 business days of notice.
5.2 On termination, Cascone Roofing is entitled to payment for all work completed and materials ordered.
